What do we collect and store?

Procedures implemented in the event of a data leak

It is a question of data leakage when a breach of security leads, accidentally or unlawfully, to the destruction, loss, alteration, unauthorized disclosure of data concerning an identified or identifiable natural person transmitted, stored or processed by otherwise, or unauthorized access to such data (Art. 4, 12) GDPR).

Our data controller  (i.e. the person who determines the purposes and means of the data processing) will in particular be required to document any personal data breach. He must thus indicate the facts concerning the breach of personal data, its effects and the measures taken to remedy it, so as to allow the data protection authority to verify compliance with the GDPR (art. 33, §5 GDPR). The Data Protection Authority will replace the current Privacy Commission, also known as the Privacy Commission. New powers and new tasks will be attributed to this entity in a new law to which the legislator is currently putting the final touches.

In some cases, our data controller will also have to notify the personal data breach to the Data Protection Authority, on the one hand, as well as to the data subject(s).

Thus, as soon as our data controller notices a violation, in addition to remedying it, limiting the damage and, if necessary, getting his organization back on track to be able to take care of his customers again, he will also have to think to notify the violation in time, and at the latest within three days.

The notification shall include the following :

When notifying the data subject, we will also inform the data subject about the measures they themselves may take to limit the risks , such as not disclosing their passwords.

Furthermore, the data protection authority will always have a margin of discretion to determine whether our data controller must communicate the data leak to the data subjects or whether one of the exceptions applies, exempting him from this communication.

When, in the context of the processing of personal data, our data controller uses a subcontractor (for example a social secretariat or a cloud service provider) processing the data only on instructions from our data controller, this processor shall immediately notify any breach to our controller upon becoming aware of it. The processor will further assist our manager in fulfilling his or her obligations, such as documenting or notifying breaches. As soon as the processor has notified our data controller of the breach, the 72-hour notice period will begin to run.

Payments

 We accept payment by credit card, Paypal, bank transfer or cash and Twint (at the store).
